Casino workers axed in 2020 awarded P30K each

The Court of Appeals (CA) has ordered Melco Resorts Leisure Corp. to pay P30,000 each in nominal damages to casino employees of the City of Dreams Manila who were terminated due to a redundancy program implemented at the height of the pandemic in 2020.

While it upheld the validity of Melco’s redundancy program, the court said the company failed to comply with the procedural due process requirement of serving a written notice to certain employees at least 30 days before their termination.

In a 38-page decision dated Sept. 12, the CA’s Third Division directed Melco to pay P30,000 to 26 terminated employees for violating their right to statutory due process.

But since it found no bad faith on the company’s part when it implemented the redundancy program, the court said the employees concerned were not entitled to reinstatement, backpay and other money claims.
