It might be prudent either for the defense, prosecution, or the impeachment court to petition the Supreme Court to determine the proper formula for deciding that number.

If one or two senators are not present, why should their vote be counted to one side or the other. The fairest way is for two-thirds to be based on the number of senators who actually voted.
